News24xx.com -  The Constitutional Court (MK) of Indonesia has canceled the rules that prohibiting an employee to marriage another co-workers on Thursday, December 14, 2017. This rule is considered to limit the rights of others to get married.

The Constitutional Court's decision to revoke the ban after a judicial review of Article 153 paragraph 1 letter f of Law Number 13 Year 2003 about manpower. That is considered to facilitate the ban on marriage with colleagues of one office.

Judge's consideration that the prohibition is not in line with the norm of article 28D paragraph 2 of the 1945 Constitution. For  judge, the marriage is included as destiny and can not be planned by human.


"Therefore, something that as fate is a condition to the exclusion of the fulfillment of human rights that can not be accepted as a valid and constitutional reason," the judge said.

The judges also judged that there was no religious, moral, public order and security norms, which were disturbed if a employee will married with their co-workers.

About the emergence of conflict in the office after marrying a colleague there is still a solution. It prevents by tightening company rules. "So as to enable the establishment of high integrity of workers," said the judge so that the work conditions can be realized a professional, good, and fair.

As information of the lawsuit against the prohibition of married co-workers was proposed by Jhoni Boetja who represented the House of Representatives Branch of the PLN Workers Union and the Regional Representatives Council.

Not only Jhoni, there are also seven other applicants who accompanied him to test the material listed under 13 / PUU-XV / 2017.

In the lawsuit, the applicant feels aggrieved the existence of the rules prohibiting marriage to colleagues one office. If you want to stay married is required one of them to resign.
